Biography
Greg V. Etter
International Arbitrator

International arbitrator Greg V. Etter is a practical executive with extensive, diverse experience in domestic and international transactions. He is a Fellow of the Chartered Institute of Arbitrators, former Vice President and General Counsel of a large international corporation, and President of G.V. Etter L.L.C., which he established to provide consulting, legal and arbitration services. Greg’s areas of expertise and experience include all types of transactions, legal affairs, natural resources, water rights, government relations, corporate governance, public relations, environmental affairs, and security. The broad variety of transactions that he has handled include mergers and acquisitions, financings, construction contracts, joint ventures, leases, options, purchase agreements, settlement agreements, consent decrees and a broad range of agreements with both domestic and foreign governments. Greg has a proven track record of excellence in dispute resolution and the handling of complex matters involving multiple disciplines.

Prior to commencing his work in the field of international arbitration, Greg spent the bulk of his career in the international mining industry as a lawyer and executive. He was Vice President, General Counsel and Secretary of Battle Mountain Gold Company, an international, S&P 500 corporation listed on the New York and multiple foreign exchanges. He played a key role in the management of Battle Mountain, in addition to having responsibility for legal matters and domestic government and environmental affairs. While at Battle Mountain, Greg was also responsible for the affairs of Crown Butte Resources Ltd., a Toronto Stock Exchange listed company, where he successfully resolved all aspects of the controversial New World matter, obtaining sixty-five million dollars from the Federal government. Greg played a key role in the 3.25 billion dollar merger of Battle Mountain and Newmont Mining Corporation, and joined Newmont as a Vice President after the merger. At Newmont, one of the world’s largest mining corporations, Greg was responsible for government affairs, public relations, social development and security. Prior to joining Battle Mountain, Greg was engaged in the private practice of law, specializing in transactions and natural resources.

Greg is a graduate of Colorado State University with a B.S. in Geology. After completing his undergraduate education, Greg worked for Arco for almost five years as a member of a mineral exploration team. He then enrolled at Washburn University School of Law, where he graduated Magna Cum Laude, first in his class.

Greg V. Etter’s recent activities include serving as a Member of the Texas Water Development Board Plateau Regional Planning Group; a Director on the Board of the Kerr Economic Development Foundation; President and Director of the Alamo City Football Club; a Speaker before the Peruvian National Institute of Mining, Petroleum and Energy Law; Chairman of the National Mining Association’s Mining Law Task Force; Co-Chairman of the International Section of the 48th Annual Rocky Mountain Mineral Law Institute; and Vice and Acting Chairman of the National Mining Association’s Government Affairs Committee. Greg is a Member of the Houston International Arbitration Club. He is available, on a selected basis, to act as an arbitrator in all types of commercial disputes.

2003 – 2005
Upper Guadalupe River Authority, Kerrville, Texas
A Reclamation and Conservation District charged with stewardship of the Upper Guadalupe River.

General Manager
Responsible for all aspects of the Authority’s activities.

  • Restored Authority’s reputation and fiscal integrity, while cutting taxes.
  • Negotiated creative wastewater treatment agreement resulting in substantial savings.

2001 – 2002
Newmont Mining Corporation, Denver, Colorado
The world’s largest gold mining company, with significant assets on five continents.

Vice President and Executive Aide to the Chairman and CEO (2002) Responsibilities related to all aspects of the Office of the Chairman and CEO.

  • Increased efficiency of the Chairman and CEO and the Executive Committee.

Vice President, External Affairs (2001 - 2002)
Directed government affairs, public relations, social development and security.

  • Established and managed External Affairs Department to achieve and maintain social licenses necessary to operate in diverse domestic and international settings.
  • Initiated and directed development of new corporate identity, establishing, for the first time, a consistent worldwide brand.

1993 – 2001
Battle Mountain Gold Company, Houston, Texas
An international, S&P 500 mining company listed on the NYSE and multiple international stock exchanges. Acquired by Newmont Mining Corporation in 2001.

Vice President, General Counsel and Secretary (1998 - 2001)
Key business role on senior management team and responsible for legal affairs. Directed domestic government relations commencing 1998 and domestic environmental affairs commencing 1999.

  • Obtained Federal legislation in less than sixty days overturning a decision of the Interior Solicitor which had resulted in the destruction of several hundred million dollars in market capitalization.
  • Integrally involved with Board and the Board’s Environmental, Safety and Health Committee, Special Committee, and Corporate Governance and Nominating Committee.
  • Obtained water rights for $400 million dollar development project.
  • Took a leading role in all aspects of $3.25 billion Battle Mountain/Newmont merger.

General Counsel and Secretary (1997 - 1998)
Managed legal affairs of the Company and member of senior management. Directed corporate budget in excess of $2M, and selected and managed additional counsel and consultants on a worldwide basis.

  • Built Legal Department for merged Company, reducing budget by over forty percent.

Corporate Attorney (1993 - 1997)
Responsible for a broad variety of U.S. and international transactional and environmental matters.

  • Negotiated numerous favorable domestic and foreign agreements.

1996 – 2001
Crown Butte Resources Ltd., Houston, Texas
A Toronto Stock Exchange listed company in which Battle Mountain Gold held a majority interest.

General Counsel and Secretary
Responsible for the affairs of the Company commencing December 1996.

  • Successfully resolved all aspects of the controversy associated with the Company’s New World project adjacent to Yellowstone National Park, obtaining $65M from the U.S.
    • Obtained critical conservation easement from owner of bulk of New World property.
    • Caused U.S. to take conservation easement in lieu of fee title for bulk of New World property.
    • Obtained Congressional authorization for U.S. to expend $65M to purchase New World assets.
    • Negotiated Consent Decree resolving substantial environmental liabilities.
    • Obtained federal appraisal of property that exceeded mandatory threshold of $65M.
    • Managed press and public relations on this matter of national interest.
